Flickr, distributed imagery and copyright (was: a question of open source ethics)

Thanks to everyone who has responded, on list and off. There seem to be some really interesting issues: Apps as frontends to websites. There are many Apps that allow users to browse Flickr (their own photos and others) including those photos 'taken nearby' (cf. mobilefotosapp.com) These are effectively providing frontends to Flickr but from within a standalone App. The user of the App is 'browsing' Flickr but can save images they like to their phone, just as they could save from the main Flickr site or even the mobile version of the Flickr site. The question is whether there is some difference (legal or otherwise) between browsing a website through a browser and through an App. Flow of images versus individual pictures Flickr makes use of the fact that images are now arguably an issue of flow and distributed media. The slideshow option to view an individual or a Group's images - again replicated on mobile Apps such as cooliris - foreground the issue that part of the cultural practice of Flickring is assembling these montages. The question is what happens when those slideshows are created and displayed on the fly, by software perhaps in a flow that changes each time the App is fired up. Augmented reality Augumented reality Apps further complicate the issue by repositioning images as data to be pulled in alongside other data across a live view. To see those images is one thing. What about using them as part of one's own imag(in)ing as I've been playing with ( http://www.flickr.com/photos/content2bdifferent/4247003217/)? In this case I'm 'using' a corporate logo (arguably copyrighted and trademarked) but what if I pull some other data from the distributed web as part of my image as Twittality (http://itunes.apple.com/ca/app/twittality-augmented-reality/id339494135?mt=8) does when it pulls in people's avatars? And does that change when I freeze that flow as my created image? Copyright and sharing Of course users of Flickr can attach licences to their images. The question is where issues of 'fair dealing' and critique (http://www.ipo.gov.uk/types/copy/c-other/c-exception.htm) come in when a user's browser (mobile or not) can cache images, they can be bookmarked, added to Evernote or Zotero, embedded etc. Perhaps a more interesting question still is how a site that positions itself as 'photo sharing' rather than 'photo album' works with that logic. If my images get part of their power and 'meaning' from their relation to the community and the wider distributed flow, where are the boundaries between my 'work/creativity' and someone else's or even the site's? Doubtless those with more legal knowledge than I will be able to point to the current state of thinking on this (and thanks for the various links people have sent) but I think the debate needs to happen at other levels than just the legal or even the ethical. This seems to me to go the heart of the issue of networks as protocol-driven (cf Galloway) assemblages where one's entry into those spaces/practices places one's photographs, photography (production and consumption) into new sets of power-full relations. If the App I am building (like those that have gone before) provide a window onto distributed space - that's one set of relations. If it allows people to filter those views and remix data - that's another set. If they can then embed, save, pass-on those views - still different sets of relations. And if they can use the App as a different sort of image maker - well different again. When Levine rephotographed Walker Evans' work, the postmodern affectation was around the display in a gallery. When the game happens in networked space, the issues are... interesting. CALL FOR PAPERS COMMUNICATION POLICY AND TECHNOLOGY (CP&T) Section International Association for Media and Communication Research (IAMCR) 28th Annual Conference, July 18-22, 2010, Braga (Portugal) Communication and Citizenship: Rethinking Crisis and Change http://www.iamcr2010portugal.com The Communication Policy and Technology (CP&T) Section of the IAMCR invites the submission of abstracts bearing on the Conference theme as well as on the Section sub-theme: ‘Citizen Participation through Technology, Access and Policy’. The media and technology landscape as well as relevant communication policies are changing fundamentally, with a shift from mass media and personal media to media for mass self-communication. The technological facilities for mediated communication are proliferating and becoming increasingly fragmented as a result of convergence and the emergence and rapid spread of new media and internet technologies like interactive digital broadcasting, mobile technologies, social computing, internet-of-things and - more recently - cloud computing. Within this transitional digital media ecosystem researchers increasingly aim to understand how participation by people and communities can (still) take a central position and to what end. How can citizens and/or consumers be empowered in participation through ICT design, usages and policy? Or what are the threats and constraints for people to become disempowered in a convergence culture? Three main areas of user (dis)empowerment are being identified as themes of special interest for CP&T section: (1) market and state ‘feudalisation’, (2) privacy and surveillance, and (3) inclusion and media literacies. The first area of concern relates to the ever increasing ‘feudalisation’ of ICT applications and services by market forces and interests. Besides this, some states are also very active in controlling, monitoring and censoring the internet. This all has serious consequences for the opportunities and potentialities of ICT enabled participation and empowerment. In this regard the debate on net neutrality and its consequences for freedom of speech, access to information, etc. is highly relevant, but also issues of copyright in relation to ownership of user generated content or the posting of copyright protected material on blogs and web 2.0 sites, the share culture, etc. The second focus area of privacy and surveillance is of course to some extent linked to the previous one. This refers to enhanced profiling and data mining practices by private and public organisations (e.g. behavioural advertising, digital footprint, deep-packet inspection technology, etc.), combined with the blurring of boundaries between public and private sphere in the co-creation and ‘produsage’ practices by different types of users (e.g. lead users, citizen journalists,...). A third area of focus deals with inclusion and multiple media literacies. This perspective links in with notions of digital participation that go beyond access. In the changing media environment, new affordances of communication tools require a reconfiguration of digital exclusion-inclusion. We need to look at different levels of capabilities, but also how inclusion is (not) built into specific media and technologies from a human-centred design perspective. At the same time this also means increasing the reach, breadth and depth of digital media and technologies across all domains of society through multiliteracies. The question remains however to what extent inclusion is always empowering, or can inclusion also lead to disempowerment. Empirical, theoretical and analytical work on these three and other related issues will form the central thrust of presentations in the CP&T section at the 2010 Braga conference. SUBMISSION INFORMATION The CP&T section welcomes abstracts (300 - 500 words) from scholars of any academic discipline bearing on aforementioned and related issues. Abstracts should state the title as well as the methods or approaches used and introduce the empirical and theoretical material on which the paper is based. Besides the abstract title and text, each submission includes author name(s), affiliation, institutional address and email address of (all) author(s). Call for Participation Digital Technology Design in Cross-cultural Contexts: Practice & Methods Workshop Thursday, April 22 - Friday, April 23, 2010 University of Twente, Enschede, Netherlands GOAL & SCOPE Analyzing and designing digital technologies across cultural, religious, ethnic, national or other boundaries is a challenge. Incorporating our rich understanding of how differences between people may generate different technological needs and expectations into how we analyze and design technologies is a crucial, yet often frustrating, murky, and unevenly executed process. This two-day workshop provides an opportunity for scholars and design practitioners working in these areas to present and discuss their work (or work-in-progress), with a particular emphasis on methodological challenges and solutions. We encourage submissions from academics, practitioners, and technologists in all fields and in all domains. The workshop will be particularly relevant to people concerned with (but not limited to) the following areas: culturally comparative research about technologies, cross-cultural use of technology, multilingual technology design, accessibility, translation and localization, globalization of technologies. We have a small amount of funds to support travel and accommodation. The University of Twente is located near an international train station, as well as near several international airports (70 km from Munster, Germany; 150 km from Dusseldorf, Germany, 165 km from Amsterdam/Schiphol, Netherlands). I post my pictures on Flickr and if my images would be pulled (which would not be the case given your research topic) I would like that permission was asked beforehand. Otherwise to me it is like opening a Pandora's box. To give you a simple case many of us post under all rights reserved and only today I saw this http://www.flickr.com/photos/petezab/4276745361/ Looks like the Independent pulled some images and some people of course did not like it. In your case at least there is no commercial use but still there is no harm in asking beforehand if that is feasible for you. I don't think photographic quoting makes sense because you would probably not quote a small part of the picture as under fair use. But then this is just my opinion. Hi. I'm after a bit of advice from wiser souls! I am developing an AHRC-funded, practice-based PhD (http://olympicarcades.theinternationale.com) at Birkbeck, University of London. In short I am exploring Flickr as a space for imag(in)ing the London 2012 Olympics through the development of a mobile phone App(aratus) using a model based on Benjamin's Arcades Project. The question I have is about collecting the Flickr rags 'n refuse. I will be pulling images from Flickr into the App allowing users to see the distributed imagery. So far so simple, no real issue over browsing Flickr. However I also want to use the App(aratus) to screengrab those images and add them back onto Flickr where they will become part of the distributed imag(in)ings. Furthermore, following Benjamin, I want to screengrab/'quote' and annotate those images with textual commentary. Both of these sets of images would be on my Flickr page. The App(aratus) would also allow the user to screengrab the flow of images and upload to their Flickr pages (which would then be pulled back into the flow).
