Hi Gail -- Although you don't phrase your question in terms of Internet research, I infer that is what you are thinking about. There are certainly many copyright suits in non-Internet research contexts, but most of the automated data retrieval suits to date have occurred in a commercial context. I am in fairly regular contact with counsel at Google, where demands to remove stored material occur pretty much daily. We (my co-authors and I) are anticipating that the focus on commercial archives will change as 'bots are increasingly used as research tools. We are already aware of researchers who have recieved formal demand letters, or have otherwise received objections from web site owners, after multiple server hits. As to "false light" claims for data mining: a little outside my area, but I am not aware of such claims, and consider them unlikely. Since data mining by definition involves identification of trends in large data sets, situations where the result is both false and affects individual reputation would probably be rare. To the extent that it might occur, I would expect a claim to be more likely outside the U.S., where there is no actual malice and/or publication rule standard to constrain the claim. (There have, for example, been some highly unfortunate hypertext defamation decisions in Germany, where group defamation claims are sometimes possible.) Dan, Thanks for sharing the information relating to copyright laws and web pages. I am aware of these limitations/restrictions which accounts for raising the questions. It would be interesting to know whether anyone conducting research has ever been sued for infringing on copyright laws or, on another related topic, slander due to data mining in a way that takes things from one context and puts them into another. Long-time reader, first-time poster. :-) I agree, interesting question, and an important question. I think the (a) particular research question and (b) population under study significantly influence the level of technical competence a researcher would need. And we must not forget that the vast majority of web users, e-mail users, online gamers, etc. do not know much at all about UNIX, perl, Java, or probably even basic ideas about how the TCP/IP protocol operates. Given this, might there be occasions where lacking in-depth computer science knowledge might actually help a researcher approaching the Internet from a social science perspective, since they may be able to more easily view the technology through the users' eyes rather than the developers' eyes? In my own research, I find that my computer science background helps me understand the contours of how the nature of a technology encourages and discourages certain forms of social interaction... but I find that my social science background helps me far more in understanding how human beings appropriate the technology in their social interaction. Those who attended Gove Allen's presentation on academic use of automated data retrieval 'bots at the Toronto conference will recall that this is both a legal and an ethical problem. Gove, Charles Ess, Gordon Davis, and I have papers on both aspects forthcoming. Given Charles' involvement in the project, I know that there is a very keen interest in having the AoIR guidelines at some point, probably not too far in the future, address at least the ethical side of the problem. Oh, and don't just check the robots.txt file -- probably better check any written TOS pages as well. The machine-readable and the human-readable prohibitions aren't always congruent. Dan L. These may be useful for some on this list Regards Danny **Please disseminate widely** **Apologies for cross-postings** =================================================== UNDP Asia-Pacific Development Information Programme (UNDP-APDIP) Releases ORDIG Policy Brief and Input Paper on Internet Governance 7 June 2005 Voices from Asia-Pacific: Internet Governance Priorities and Recommendations =================================================== After almost ten months of research and activities, UNDP-APDIP's Open Regional Dialogue on Internet Governance (ORDIG*) has produced a two-part report entitled, "Voices from Asia-Pacific: Internet Governance Priorities and Recommendations" - consisting of 1) the ORDIG Policy Brief and Executive Summary, and 2) the ORDIG Input Paper for the UN Working Group on Internet Governance (WGIG) and the World Summit on the Information Society (WSIS). These documents stem from months of consultations involving stakeholder groups from the public and private sectors, as well as civil society. ORDIG consulted over 3,000 stakeholders through sub-regional meetings, jointly organized with UNESCAP and others; a region-wide online forum that allowed for open and candid discussions on the issues; and a region-wide, multi-lingual, issues-based online survey that looked at the Internet governance priorities of the region. The resulting two reports are the synthesis, consolidation, and reading of the voices from the Asia-Pacific region. They outline the principles and dimensions that make up the framework for building recommendations, which are provided in the documents at two levels - general and specific recommendations. Issues and recommendations covered in the Infrastructure dimension are access costs, VOIP, and wireless networks. Issues and recommendations covered in the Logical dimension are DNS management, IP address management, and technical standards. Issues covered in the Social/Developmental dimension are cultural diversity and participation.
